Medical Liability Hearing
Lauree Barreca and Kimberly Bailey, Senior Counsels for Claims and Litigation for the Johns Hopkins Health System, traveled to Annapolis on Wednesday, February 25, for a Senate Judicial Proceedings Committee hearing on medical liability issues. Ms. Bailey testified in opposition to increasing the cap on noneconomic damages that may be recovered in health care malpractice and other civil actions for a catastrophic injury. The bill is a top priority for the Maryland Association for Justice (formerly Maryland Trial Lawyers Association). The bill was opposed at the hearing by the Maryland Hospital Association, Maryland Defense Counsel, and key business groups.


One Maryland Tax Credit Hearing
Andy Frank, Senior Adviser to the President on Economic Development, testified before the Senate Budget & Taxation Committee on Wednesday, February 25 in support of expanding the One Maryland Economic Development Tax Credit. Under current law, a business with at least 25 employees can claim the tax credit for startup or project costs associated with establishing or expanding a business facility in a State-designated priority funding area. The tax credit was established sixteen years ago. Senator Bill Ferguson (D – Baltimore City) introduced legislation to modernize the tax credit by allowing a business incubator to qualify for benefits under the program by aggregating the number of jobs created by businesses at the facility. This change could have a significant beneficial impact on business incubators located in Baltimore City, including Fast Forward.

Authorizing the Inspector General in the Department of Health and Mental Hygiene, or a designee of the Inspector General, to subpoena any person or evidence, administer oaths, and take depositions and other testimony for the purpose of investigating fraud, waste, or abuse of departmental health program funds; authorizing a specified court to take specified actions if a person fails to comply with a specified order or subpoena; etc.

HB481/SB588 Stormwater Management - Watershed Protection and Restoration Program - Repeal

Repealing the requirement that, on or before July 1, 2013, a county or municipality subject to a specified municipal stormwater permit adopt and implement laws or ordinances to establish a watershed protection and restoration program; repealing the requirement that a county or municipality maintain or administer a local watershed protection and restoration fund; repealing the requirement that a county or municipality establish and annually collect a stormwater remediation fee; etc.

SB834/HB990 Maryland Health Benefit Exchange - Qualified Health Plans - Standards

Altering specified requirements for certification as a qualified health plan in the Maryland Health Benefit Exchange; prohibiting a qualified health plan from using a benefit design or implementing a benefit design in a manner that discriminates in a specified manner; prohibiting specified carriers from making specified formulary changes during a specified period; etc.

HB571 Institutions of Higher Education - Sexual Assault - Policy and Survey

Requiring a specified sexual assault policy adopted by the governing board of each institution of higher education to conform with the requirements of a specified federal law; requiring a specified sexual assault policy to include a prohibition of the imposition of sanctions for a specified violation of the institution of higher education's student conduct policy for specified students except if a specified determination is made and the entering of a memorandum of understanding with specified entities; etc.

HB578/SB514 Higher Education - Net Price Calculator Improvement Act - Establishment

Requiring each institution of higher education in the State to meet specified requirements for specified net price calculators on or before July 1, 2016; prohibiting specified institutions of higher education from allowing specified personally identifiable information provided to a specified net price calculator to be sold or otherwise made available to specified third parties; etc.

HB667 Higher Education Institutions - Sexual Assault, Violence, and Stalking - Prevention and Outreach Policies

Requiring the governing boards and boards of trustees of each public senior higher education institution and each community college to adopt specified policies, statements, programs, and procedures relating to sexual assault, domestic violence, dating violence, and stalking on or before October 1, 2015; etc.

HB749/SB817 Higher Education - Sexual Assault Policies - Reporting

Requiring the governing boards of specified institutions of higher education to update and submit to the Maryland Higher Education Commission a specified written policy on sexual assault by August 1, 2016; requiring the sexual assault policy to include specified procedures; requiring the policy to require an institution of higher education to enter into and update specified memoranda of understanding; etc.

HB779/SB816 Higher Education - Low-Income Student Outreach and College Access Act of 2015

Establishing the Low-Income Student Outreach and College Access Pilot Program targeting low-income Maryland high school graduates; requiring the Maryland Higher Education Commission to administer the Program; establishing specified eligibility requirements for participation in the Program; requiring the Commission to submit a summary report on the Program on or before December 1, 2017, and December 1, 2018; beginning in fiscal year 2017, requiring the Governor to appropriate $500,000 in the annual State budget for the Program; etc.

HB839 Education - Institutions of Higher Learning - Affirmative Consent Standard

Requiring, by September 1, 2016, that a policy on sexual assault adopted by the governing board of each institution of higher education include a specified affirmative consent standard; requiring a specified written policy on sexual assault to include a specified standard and specified statements; requiring a specified sexual assault policy to provide that specified circumstances negate a valid excuse to an alleged lack of affirmative consent; etc.

SB496/HB672 Maryland College Education Export Act of 2015

Authorizing the Maryland Higher Education Commission to enter into the State Authorization Reciprocity Agreement; and exempting specified institutions that participate in the State Authorization Reciprocity Agreement from the requirement to register with the Commission if they enroll Maryland students in a fully online distance education program in the State.

SB578 Higher Education - Sexual Assaults - Mandatory Reporting

Requiring the sexual assault policy of institutions of higher education in the State to include compliance with specified provisions of law relating to mandatory reporting of sexual assaults; requiring a faculty member, an administrator, or a full-time staff member of an institution of higher education who obtains specified information to report the information within 24 hours of obtaining the information to the appropriate law enforcement official; making specified exceptions; etc.

Establishing a system for adjudication of a claim involving a birth-related neurological injury; excluding specified rights and remedies of a claimant and specified other persons; providing for specified procedures; providing for specified benefits and compensation of a claimant under the Act; establishing the Maryland No-Fault Birth Injury Fund; providing for specified premiums and insurance surcharges to be used to finance and administer the Fund; etc.

SB357/HB631 Program Open Space - Baltimore City Grants - Increase and Inflation Adjustment

Increasing, from $1,500,000 to $6,000,000, a specified statutory minimum grant to Baltimore City, payable from the State's share of the proceeds of Program Open Space, for specified purposes related to Program Open Space; requiring the Department of Natural Resources to increase the grant each fiscal year by applying the growth in a specified consumer price index to the amount of grants received in the prior fiscal year; etc.

Altering eligibility criteria for credits under the One Maryland Economic Development Tax Credit to include persons who establish or expand a business facility that, for specified business incubators, creates at least 25 qualified positions at the facility under specified circumstances; requiring, in order to be certified as a qualified business entity for specified credits, a specified business incubator to submit specified information to the Secretary of Business and Economic Development; etc.

Establishing specified protections for interns and applicants for internships from specified discriminatory acts; providing that a specified intern has access to a specified complaint resolution procedure or, under specified circumstances, may file a complaint with the Maryland Commission on Civil Rights for specified administrative remedies; providing that the Act does not create an employment relationship between an employer and an intern for the purposes of specified remedies or specified provisions of law; etc.
