Behavioral Health HB885 Behavioral Health Administration - Creation and Maintenance of Mental Health Professional Profiles (Patient Protection Provider Information Act) Requiring the Behavioral Health Administration to create and maintain public individual profiles on specified mental health professionals that include specified information; requiring the Administration to provide a mechanism for the notification and prompt correction of factual inaccuracies in specified profiles; requiring the State Board of Physicians and the State Board of Professional Counselors and Therapists to provide promptly specified information to the Administration; etc. Hearing Date: Tue 2/23 1:00 PM Effective Date: October 1, 2016 HB908 Hospitals - Establishment of Substance Use Treatment Programs - Requirements Requiring specified hospitals to establish a specified substance use treatment program; providing that the purpose of the program is to identify patients in need of substance use treatment and, if appropriate, admit the patient or, if admission is not required, to direct the patient to an outpatient treatment setting; requiring specified hospitals to operate or contract to operate specified substance use treatment units; requiring the program to include a substance use treatment counselor; etc. Hearing Date: Tue 2/23 1:00 PM Effective Date: October 1, 2016 [GO TO TOP] [GO TO BILL LIST] HB771/SB71 Public and Nonpublic Schools - Student Diabetes Management Program Requiring the State Department of Education and the Department of Health and Mental Hygiene to establish specified guidelines for the training of employees to become trained diabetes care providers; establishing that the purpose of the Student Diabetes Management Program is to have trained employee volunteers available to provide diabetes care services to students with diabetes during school hours and, when possible, at school-sponsored activities, including field trips and extracurricular activities; etc. Hearing Date: Mon 3/7 1:00 PM Effective Date: July 1, 2016 HB999/SB905 Commission on Innovation and Excellence in Education Establishing the Commission on Innovation and Excellence in Education; providing for the composition, chair, and staffing of the Commission; requiring specified appointments to be made to ensure diversity within the Commission; prohibiting a member of the Commission from receiving specified compensation, but authorizing the reimbursement of specified expenses; requiring the Commission to review the findings and recommendations of a specified study, review specified education finance formulas, and review specified accountability measures; etc. Hearing Date: Thu 3/3 1:00 PM Effective Date: June 1, 2016 HB1100 School Counseling Program - Counseling Services - Requirements Requiring a county board of education to require the School Counseling Program in the county to provide counseling services to students during the entire calendar year; requiring the county board, in consultation with specified public schools, to determine student needs for counseling services during a specified period of time and to develop a specified plan; and requiring a county board to submit a specified report to the State Department of Education on or before July 1 each year. Hearing Date: Fri 3/11 1:00 PM Effective Date: July 1, 2016 HB1139 Education - Maryland Community School Strategy for Excellence in Public Education Act Providing for the intent and purpose of specified community schools; authorizing specified local school systems and specified public schools to form specified partnerships to provide specified community school services; requiring specified funds to be distributed to specified county boards of education based on specified calculations for specified fiscal years; providing the intent of the General Assembly; etc. Hearing Date: Thu 3/10 1:00 PM Effective Date: July 1, 2016 HB1325/SB755 State Department of Education - Breakfast and Lunch Programs - Funding (Free School Meals for Students From Low- and Middle-Income Families Act) Repealing the requirement that the State Board of Education adopt and publish standards for the administration of a subsidized feeding program; requiring the State to be responsible for the student share of the costs of specified meals; prohibiting a county board from charging specified students for any portion of the cost of a meal; etc. Hearing Date: Mon 3/7 1:00 PM Effective Date: July 1, 2016 [GO TO TOP] [GO TO BILL LIST] SB928/HB1492 Task Force to Study the Nurse Shortage in Maryland Establishing the Task Force to Study the Nurse Shortage in Maryland; providing for the composition, chair, and staffing of the Task Force; prohibiting a member of the Task Force from receiving specified compensation, but authorizing the reimbursement of specified expenses; requiring the Task Force to study and make recommendations regarding certain matters relating to changes in the nursing profession that have resulted in a shortage of nurses in the State and nation; etc. Hearing Date: Fri 2/19 1:00 PM Effective Date: June 1, 2016 [GO TO TOP] [GO TO BILL LIST] SB929/HB1318 Health Benefit Plans - Network Access Standards and Provider Network Directories Requiring specified carriers to maintain or adhere to specified standards that assure that specified enrollees have specified access to specified health care providers and covered services; requiring specified carriers to file with the Maryland Insurance Commissioner a specified plan for review and approval; etc. Hearing Date: Wed 3/2 1:00 PM Effective Date: June 1, 2016 [GO TO TOP] [GO TO BILL LIST] HB896 Drivers' Licenses and Identification Cards - Notation of Consent to Experimental Emergency Medical Treatment Requiring the Motor Vehicle Administration to make a notation on a driver's license or identification card of an individual who consents to experimental emergency treatment in the event the applicant is incapacitated and unable to consent to the treatment; requiring the Administration to notify an individual who selects a consent notation that the notation will remain effective until the individual requests that the designation be removed; etc. Hearing Date: Thu 3/3 1:00 PM Effective Date: October 1, 2016 SB898/HB1418 Public Health - Emergency Use Auto-Injectable Epinephrine Program for Food Service Facilities Establishing the Emergency Use Auto-Injectable Epinephrine Program for Food Service Facilities in the Department of Health and Mental Hygiene; establishing that the purpose of the Program is to provide a means of authorizing individuals in a food service facility to obtain and store auto-injectable epinephrine and administer auto-injectable epinephrine to individuals who are experiencing anaphylaxis when physician or emergency medical services are not immediately available; etc. Hearing Date: Effective Date: October 1, 2016 SB926/HB399 Lyme Disease - Laboratory Test - Required Notice Requiring specified health care providers to provide a specified notice to a patient for whom the health care provider orders a laboratory test for the presence of Lyme disease; and providing immunity from liability, under specified circumstances, for specified health care providers for providing the notice. Hearing Date: Effective Date: October 1, 2016 [GO TO TOP] [GO TO BILL LIST] SB895/HB1235 Maryland Medical Assistance Program - Nursing Services - Skills Checklist Requiring the Secretary of Health and Mental Hygiene to specify in regulations the skills checklist used as part of the process of determining the competency of nurses, certified nursing assistants, and home health aides to render nursing services through a residential service agency or a home health agency that is participating in the Maryland Medical Assistance Program. Hearing Date: Wed 3/2 1:00 PM Effective Date: October 1, 2016 SB899/HB1217 Maryland Medical Assistance Program - Specialty Mental Health and Substance Use Disorder Services - Parity Requiring the Department of Health and Mental Hygiene, on or before June 30, 2017, to adopt regulations to ensure that the Maryland Medical Assistance Program is in compliance with specified federal laws; requiring the regulations to include standards regarding treatment limitations for specialty mental health and substance use disorder services that comply with the federal laws and relate to specified items; etc. Hearing Date: Wed 3/2 1:00 PM Effective Date: October 1, 2016 SB939/HB1181 Maryland Medical Assistance Program - Nursing Homes - Advance Payments Requiring the Department of Health and Mental Hygiene to make a specified advance payment to a nursing home at the request of the nursing home under specified circumstances; providing that the advance payment may not exceed 50% of the estimated amount due for the uncompensated services; requiring the Department to pay the balance due to a nursing home under specified circumstances; requiring the Department to recover specified advance payments in a specified manner under specified circumstances; etc. Hearing Date: Wed 3/9 1:00 PM Effective Date: July 1, 2016 [GO TO TOP] [GO TO BILL LIST] SB574/HB869 Civil Actions - Noneconomic Damages - Catastrophic Injury Altering the maximum amount of noneconomic damages that may be recovered in health care malpractice and other civil actions for a catastrophic injury under specified circumstances; etc. Hearing Date: Thu 2/25 1:00 PM Effective Date: October 1, 2016 [GO TO TOP] [GO TO BILL LIST] HB826 Prescription Drug Repository Program - Repository Inventory Requirement - Revision Requiring a repository that participates in the Prescription Drug Repository Program to maintain a separate inventory of donated prescription drugs and medical supplies that the repository intends to dispense under a specified provision of law, instead of a separate inventory of all donated prescription drugs. Hearing Date: Thu 2/25 1:00 PM Effective Date: October 1, 2016 [GO TO TOP] [GO TO BILL LIST] HB699/SB700 Department of Health and Mental Hygiene - Biosafety Level 3 Laboratories Requiring the Department of Health and Mental Hygiene to identify specified biosafety level 3 (BSL-3) laboratories and the location of the laboratories; requiring the Department to collect information from the laboratories relevant to public health and safety; requiring the laboratories to report specified information to the Department; requiring the Department to report annually the number and location of the laboratories to officials in each local jurisdiction; etc. Hearing Date: Thu 3/10 1:00 PM Effective Date: October 1, 2016 [GO TO TOP] [GO TO BILL LIST] HB343/SB993 Procurement - Equal Pay Certificates - Requirement Prohibiting a unit from awarding a procurement contract to a specified contractor unless the contractor has a specified equal pay certificate or a specified written exemption; requiring a specified contractor to apply for an equal pay certificate by submitting to the Commissioner of Labor and Industry a specified application fee and a specified statement; authorizing the Commissioner to revoke or suspend an equal pay certificate under specified circumstances; etc. Hearing Date: Tue 3/1 1:00 PM Effective Date: October 1, 2016 HB721/SB711 Prevailing Wage Rates Reform Act of 2016 Expanding the applicability of the prevailing wage rate law to political subdivisions, agencies, and public works on property where the State, a political subdivision, or an agency is the owner or lessee by altering the definition of "public body"; providing that the prevailing wage rate law applies to public work contracts greater than $25,000; requiring that prevailing wage rates be calculated using wage rates established by specified collective bargaining agreements; etc. Hearing Date: Fri 3/4 1:00 PM Effective Date: October 1, 2016 HB740/SB485 Labor and Employment - Family and Medical Leave Insurance Program - Establishment Establishing the Family and Medical Leave Insurance Program; providing for the manner in which the Program is to be administered; providing for the powers and duties of the Secretary under the Program; requiring, beginning on January 1, 2017, specified employees to pay the Secretary specified contributions; requiring, beginning on July 1, 2018, an individual to meet specified conditions to be eligible for benefits; etc. Hearing Date: Tue 3/1 1:00 PM Effective Date: June 1, 2016 HB792/SB914 Public Work Contracts - Payroll Reporting Requirements (The Transparency Act of 2016) Applying specified payroll reporting requirements under the prevailing wage law to specified contractors under specified public work contracts with a value of at least $400,000; and providing that specified contractors under specified public work contracts with a value of less than $500,000 are not required to comply with specified payroll reporting requirements under the prevailing wage law.
