Behavioral Health HB189 Hospitals - Substance Use Treatment Demonstration Program - Requirements Authorizing up to five hospitals in the State to participate in a substance use treatment demonstration program; providing that the purpose of the demonstration program is to identify best practices to identify patients potentially in need of treatment, screen patients, and refer patients in need of substance use treatment to specified services; requiring each participating hospital to operate an inpatient and outpatient substance use treatment program or ensure that specified treatment services are made available; etc. Hearing Date: Effective Date: January 1, 2018 HB316/SB428 State Board of Pharmacy - Dispensing of Drugs Containing Controlled Dangerous Substances - Requirements Requiring, except under specified circumstances, a pharmacist to dispense drugs that contain substances listed in Schedule II, Schedule III, Schedule IV, or Schedule V in lockable vials; authorizing the State Board of Pharmacy to adopt specified regulations; requiring the Board to create and make available to pharmacists a statement that educates patients on the potential for abuse and diversion of drugs that contain specified controlled dangerous substances; etc. Hearing Date: Effective Date: October 1, 2017 HB519 Public Health - Overdose and Infectious Disease Prevention Safer Drug Consumption Facility Program Authorizing the establishment of an Overdose and Infectious Disease Prevention Safer Drug Consumption Facility Program by a community-based organization; requiring the Department of Health and Mental Hygiene or a local health department to make a specified determination on a specified application based on specified criteria and within a specified period of time; requiring a Program to provide specified services; etc. Hearing Date: Effective Date: October 1, 2017 SB433 Substance Use Treatment - Inpatient and Intensive Outpatient Programs - Consent by Minor Authorizing parents or specified guardians to apply, on behalf of a minor, for admission of the minor to a certified intensive outpatient alcohol and drug abuse program; requiring specified programs to make a specified note on a specified application in order for an individual to be retained for specified treatment; providing that specified programs have the right to discharge an individual admitted for specified treatment under specified circumstances; etc. Hearing Date: Wed 2/15 1:00 PM Effective Date: October 1, 2017 [GO TO TOP] [GO TO BILL LIST] HB467 Providing Our Workers Education and Readiness (POWER) - Apprenticeship Act Requiring a contractor or subcontractor awarded a specified contract for a specified construction project that receives specified funding from the State capital budget to be affiliated with, and to use apprentices from, an apprenticeship program that is registered with the Department of Labor, Licensing, and Regulation or the United States Department of Labor, or requiring the contractor or subcontractor to make specified payments to the State Apprenticeship Training Fund or to specified apprenticeship programs; etc. Hearing Date: Tue 2/21 1:00 PM Effective Date: June 1, 2017 [GO TO TOP] [GO TO BILL LIST] HB373/SB226 Biotechnology Investment Tax Credit - Qualified Maryland Biotechnology Company - Definition Altering the definition of "qualified Maryland biotechnology company" to extend a specified period of time from a specified date that an active business may claim the biotechnology tax credit; and applying the Act to initial tax credit certificates issued after June 30, 2017. Hearing Date: Effective Date: June 1, 2017 SB364 One Maryland Economic Development Tax Credits - Business Incubators, Enterprise Zones, and Regional Institution Strategic Enterprise Zones Altering specified eligibility criteria for specified credits under the One Maryland Economic Development Tax Credit to include specified persons who establish or expand in specified areas a business facility that, for business incubators, creates a specified aggregate number of qualified positions at the facility under specified circumstances; authorizing specified business incubators to claim a refund of specified project tax credits or start-up tax credits; applying the Act to all taxable years beginning after December 31, 2016; etc. Hearing Date: Effective Date: July 1, 2017 HB282 Economic Development - One Maryland Tax Credit - Expansion Expanding the eligibility requirements for the One Maryland Economic Development Tax Credit to include specified qualified businesses that establish or expand a specified business facility that is located in a qualified distressed political subdivision; expanding eligibility for the credit by altering, under specified circumstances, the number of qualified positions that must be created and the eligible activities in which a person may engage at a new or expanded business facility; etc. Hearing Date: Wed 2/8 1:00 PM Effective Date: July 1, 2017 HB347 Cybersecurity Investment Fund and Enterprise Fund - Higher Education Loan Repayment - Expanded Use Expanding the authorized uses of the Cybersecurity Investment Fund and the Enterprise Fund within the Maryland Technology Development Corporation to include authorizing specified companies to use funding received from the Fund to assist in the repayment of higher education loans owed by employees of the company who meet specified income limits; requiring companies that use specified funding to assist specified employees in the repayment of higher education loans to provide a specified amount of company funding to the employees; etc. Hearing Date: Wed 2/22 1:00 PM Effective Date: July 1, 2017 [GO TO TOP] [GO TO BILL LIST] HB229/SB186 Environment - Polystyrene Food Service Products and Polystyrene Loose Fill Packaging - Prohibition on Sale Prohibiting a person from selling in the State specified expanded polystyrene food service products or loose fill packaging on or after January 1, 2018; prohibiting specified food service businesses from selling or providing food in specified expanded polystyrene food service products on or after January 1, 2018; requiring a county health department to impose specified penalties for violations of the Act; requiring a county health department to notify the Department of the Environment specified violations; etc. Hearing Date: Wed 2/15 1:00 PM Effective Date: July 1, 2017 HB340/SB405 Criminal Law - Extortion - Unauthorized Software Prohibiting the creation of or unauthorized introduction into a computer, computer system, or computer network of unauthorized software designed to restrict access or use by an authorized user for the purpose of extorting money, property, or anything of value from another; establishing that a violation is a felony with up to 10 years imprisonment and up to a $10,000 fine; providing that a person who has suffered a specified injury because of a specified violation may bring a civil action in a specified court; etc. Hearing Date: Tue 2/7 1:00 PM Effective Date: October 1, 2017 HB522/SB427 Food Service Facilities - Automated External Defibrillator Program (The Joe Sheya Act) Requiring the owner and operator of a food service facility with an annual gross income of more than $400,000 and a seating capacity of 50 or more persons to develop and, beginning October 1, 2018, to implement an automated external defibrillator program that meets specified requirements; and requiring the Department of Health and Mental Hygiene and the Maryland Institute for Emergency Medical Services Systems jointly to adopt specified regulations. Israel and Roger "Pip" Moyer End-of-Life Option Act Authorizing an individual to request aid in dying by making specified requests; prohibiting another individual from requesting aid in dying on behalf of an individual; requiring a written request for aid in dying to meet specified requirements; establishing specified requirements for witnesses to a written request for aid in dying; requiring a written request for aid in dying to be in a specified form; etc. Hearing Date: Thu 2/16 1:00 PM Effective Date: October 1, 2017 HB403/SB369 Maryland Patient Referral Law - Compensation Arrangements Under Federally Approved Programs and Models Exempting, under specified circumstances, a health care practitioner who has a specified compensation arrangement with a health care entity from a provision of law that prohibits a health care practitioner from referring a patient or directing specified persons to refer a patient to a specified health care entity; providing that the exemption is null and void if the Maryland Insurance Commissioner issues a specified order; etc. Hearing Date: Effective Date: October 1, 2017 HB444 Public Health - Participation in Healthy Lifestyle Programs - Incentives and Tax Credits Altering the authorized uses of the HealthChoice Performance Incentive Fund to include financial incentives designed to promote participation in a healthy lifestyle program by Maryland Medical Assistance Program managed care organization enrollees; authorizing an individual who meets specified requirements to claim a credit against the State income tax for participation in a healthy lifestyle program; establishing a credit of $500 for specified individuals; applying the Act to taxable years beginning after December 31, 2017; etc. Hearing Date: Effective Date: October 1, 2017 HB445/SB185 Public Health - Repeal of AIDS Education Program for Persons Convicted of Drug- or Sex-Related Crimes Repealing a specified educational program on acquired immune deficiency syndrome (AIDS) for persons who plead guilty or nolo contendere to or are found guilty of specified drug- or sex-related crimes. Hearing Date: Effective Date: October 1, 2017 HB498/SB562 Health Care Decisions Act - Advance Directives and Surrogate Decision Making - Disqualified Individuals Prohibiting specified individuals from serving as a health care agent under specified circumstances; prohibiting specified individuals from making decisions about health care for specified individuals who have been certified to be incapable of making an informed decision under the Health Care Decisions Act; etc. Hearing Date: Effective Date: October 1, 2017 HB518 Public Health - Prenatal Infectious Disease Testing Establishing the Prenatal Infectious Disease Testing Advisory Group in the Department of Health and Mental Hygiene to make recommendations to the Department on infectious disease testing during prenatal care, including recommendations regarding consent, the stage of pregnancy at which testing should occur, support services, and counseling; providing for the membership of the Advisory Group; specifying the terms of the initial members of the Advisory Group; providing for the appointment of the chair; etc. Hearing Date: Effective Date: October 1, 2017 SB340 University of Maryland School of Public Health, Center for Health Equity - Workgroup on Health in All Policies Requiring the University of Maryland School of Public Health, Center for Health Equity, in consultation with the Department of Health and Mental Hygiene, to convene a workgroup to study and make recommendations to units of State and local government on laws and policies to implement that will positively impact the health of residents of the State; requiring the University of Maryland School of Public Health, Center for Health Equity to report the workgroup findings to specified committees of the General Assembly; etc. Hearing Date: Wed 2/8 1:00 PM Effective Date: June 1, 2017 SB369/HB403 Maryland Patient Referral Law - Compensation Arrangements Under Federally Approved Programs and Models Exempting, under specified circumstances, a health care practitioner who has a specified compensation arrangement with a health care entity from a provision of law that prohibits a health care practitioner from referring a patient or directing specified persons to refer a patient to a specified health care entity; providing that the exemption is null and void if the Maryland Insurance Commissioner issues a specified order; etc. Hearing Date: Thu 2/16 1:00 PM Effective Date: October 1, 2017 [GO TO TOP] [GO TO BILL LIST] HB509/SB429 Higher Education - Student Loan Notification Letter Requiring institutions of higher education that receive State funds to provide specified information to students regarding their education loans; requiring the education loan information to be provided annually, concurrent with the student's first tuition bill of a calendar year; providing that the information shall include specified assumptions and may include specified statements; prohibiting an institution of higher education from incurring a specified liability; etc. Hearing Date: Effective Date: July 1, 2017 [GO TO TOP] [GO TO BILL LIST] HB387 Assisted Living Program Transparency Act Requiring specified assisted living programs to post specified services disclosure statements on their Web sites. Hearing Date: Effective Date: October 1, 2017 HB443 Assisted Living Programs - Licensure Fees Repealing a requirement that the Department of Health and Mental Hygiene adopt regulations requiring the Secretary of Health and Mental Hygiene to charge specified fees in a specified manner; and requiring the Department to adopt regulations that establish a specified application fee for an assisted living program license. Hearing Date: Effective Date: July 1, 2017 HB493 Long-Term Care Insurance - Premium Rates Requiring the Maryland Insurance Commissioner to establish by regulation specified rate tables to be used by carriers that offer, issue, or deliver policies, contracts, or certificates of long-term care insurance in the State to determine specified premium rates; prohibiting a carrier from imposing premium rate increases under specified circumstances; etc. Hearing Date: Effective Date: October 1, 2017 HB515 Hospitals - Establishment of Substance Use Treatment Program - Requirements Requiring specified hospitals to establish a specified substance use treatment program; providing that the purpose of the program is to identify patients in need of substance use treatment and, if appropriate, admit the patient or, if admission is not required, to direct the patient to an outpatient treatment setting; requiring specified hospitals to operate or contract to operate specified substance use treatment units or to refer specified patients to a specified treatment unit; etc. Hearing Date: Effective Date: October 1, 2018 [GO TO TOP] [GO TO BILL LIST] HB487/SB267 Natalie M. LaPrade Medical Cannabis Commission - Composition and Licenses Altering the membership of the Natalie M. Hearing Date: Thu 2/2 1:00 PM Effective Date: October 1, 2017 HB398/SB404 Labor and Employment - Equal Pay - Job Announcement and Salary History Information Disclosures Requiring employers with 15 or more employees to include specified information in a job announcement to recruit an employee or independent contractor to fill a position within the employer's organization; prohibiting specified employers from paying less than the minimum rate of pay included in a specified job announcement to a specified employee; prohibiting specified employers from seeking salary history information for an employee by specified methods; etc. Hearing Date: Tue 2/14 1:00 PM Effective Date: October 1, 2017 HB440/SB55 Employers of Ex-Offenders - Liability for Negligent Hiring or Inadequate Supervision - Immunity Establishing that specified employers are not liable for negligently hiring or failing to adequately supervise an employee based on evidence that the employee has received probation before judgment for an offense or has been convicted of an offense under specified circumstances; providing that the Act does not limit or abrogate specified other immunities or defenses; applying the Act prospectively; etc. Hearing Date: Tue 2/21 1:00 PM Effective Date: October 1, 2017 HB473 Crimes - Child Abuse and Neglect - Failure to Report Establishing that specified persons who are required to provide specified notice or make reports of suspected child abuse or neglect may not knowingly fail to give the notice or make the reports; establishing a misdemeanor and penalties of a fine not to exceed $1,000 or imprisonment up to 1 year, or both, for knowingly failing to report child abuse or neglect; etc. Hearing Date: Thu 2/9 1:00 PM Effective Date: October 1, 2017 HB502/SB480 Criminal Procedure - Shieldable Conviction - Motion to Vacate Judgment Altering the type of conviction on which a specified motion to vacate may be based; altering the contents of a specified motion to vacate; requiring a specified person to provide the State's Attorney with a copy of the motion; authorizing the State's Attorney to file a response to a motion to vacate; etc. Hearing Date: Tue 2/14 1:00 PM Effective Date: October 1, 2017 HB506/SB468 Labor and Employment - Noncompete and Conflict of Interest Clauses Providing that specified noncompete and conflict of interest provisions that restrict the ability of an employee to enter into employment with a new employer or to become self-employed in the same or similar business or trade are null and void as being against the public policy of the State. Hearing Date: Tue 2/14 1:00 PM Effective Date: October 1, 2017 SB194 Workers' Compensation - Medical Benefits - Payment of Medical Services and Treatment Requiring a provider to submit to an employer or an employer's insurer, within 45 days of treatment or medical service to a covered employee, a bill for and documentation summarizing the medical services or treatment provided to a covered employee under a specified provision of law; and prohibiting the employer or the employer's insurer from being required to pay a bill submitted after a specified period of time except under specified circumstances.
