Quick Look at the Fiscal 2019 Budget
Governor Hogan released his fiscal 2019 budget on Wednesday, and although details will continue to emerge, there are a number of items that we can report. The budget totals $44.4 billion, a 2% increase over the current year. The $17.7 billion general fund is projected to close the year with a fund balance of $101 million; when combined with the Rainy Day Fund, nearly $1 billion is in the State’s reserves. Appropriations for key priority areas:

The Governor’s proposed fiscal 2019 capital budget was also released on Wednesday. The $1 billion budget includes the following proposed funding of Johns Hopkins’ capital requests:

Other budget items of interest to Johns Hopkins include $250,000 each for the East Baltimore Technology Park and Roberta’s House; and $750,000 for the Comprehensive Autism Center at the Kennedy Krieger Institute.

HB33 Guardianship of Disabled Persons - Voluntary Admission to Mental Facility

Authorizing a certain disabled person to apply for voluntary admission to a mental facility under certain circumstances; providing that a certain certificate for admission of a disabled person shall be based on a certain examination and be in the form that the Secretary of Health adopts by rule or regulation; requiring the rules and regulations to require certain contents of the form; prohibiting a certificate from being used for admission under certain circumstances; etc.

HB79 Opioid Maintenance Therapy Programs - License Applications - Notice to Members of the General Assembly

Prohibiting the Secretary of Health from issuing a license to an opioid maintenance therapy program unless the Secretary gives notice of an application for a certain license by certified mail to each member of the General Assembly in whose district the opioid maintenance therapy program will be located before the Secretary issues the license; requiring the Department of Health to give the notice at least 30 days before the date of the approval of the license; etc.

HB88 Public Health - Prescription Drug Monitoring Program - Revisions

Requiring, instead of authorizing, the Prescription Drug Monitoring Program to review prescription monitoring data for indications of a possible misuse or abuse of a monitored prescription drug; requiring, instead of authorizing, the Program to report the possible misuse or abuse to the prescriber or dispenser of the monitored prescription drug under certain circumstances; requiring the Program to provide education to the prescriber or dispenser of the monitored prescription drug under certain circumstances; etc.

SB235 Labor and Employment - Minimum Wage - Indexing

Increasing, except under certain circumstances, the State minimum wage rate in effect for certain periods of time based on annual growth in a certain Consumer Price Index; and requiring the Commissioner of Labor and Industry, beginning March 1, 2019, to annually determine and announce the growth in the Consumer Price Index, if any, and the new State minimum wage rate.

Prohibiting a person from importing, selling, or offering for sale certain child care products containing one-tenth of 1% of certain flame-retardant chemicals and intended for use by a child under the age of 12 years; authorizing the Secretary of Health to suspend implementation of certain provisions of the Act if the Secretary makes a certain determination; altering the date by which the Maryland Department of Health is required to adopt certain regulations; etc.

SB161 Public and Nonpublic Schools - Student Sickle Cell Disease Management Programs

Requiring the State Department of Education and the Maryland Department of Health to establish certain guidelines for certain employees to utilize in the management of a student's sickle cell disease while the student is on the premises of a public or nonpublic school during certain hours and at school-sponsored activities, in collaboration with certain individuals; requiring a county board of education, on or before July 1, 2019, to establish a policy for public schools within its jurisdiction to utilize certain guidelines; etc.

SB166 Corporate Income Tax - Federal Repatriation Holiday

Providing a subtraction modification under the Maryland corporate income tax for certain dividends included in federal taxable income as a result of a certain repatriation holiday enacted by federal legislation; requiring the Comptroller to provide for the administration of the Act if certain federal legislation is enacted; applying the Act to all taxable years beginning after December 31, 2017; etc.

SB195 Business Relief and Tax Fairness Act of 2018

Prohibiting the State Department of Assessments and Taxation from imposing a fee for the filing of certain documents by corporations or business entities with 10 or fewer employees; requiring certain corporations to compute Maryland taxable income using a certain combined reporting method; requiring, subject to certain regulations, certain groups of corporations to file a combined income tax return reflecting the aggregate income tax liability of all the members of the group; etc.

SB211 Behavioral Health Programs - Medical Directors - Telehealth

Requiring that regulations adopted under certain provisions of law regulating behavioral health programs include provisions authorizing a medical director of a behavioral health program located in a federally designated health professional shortage area to provide services through telehealth, and prohibiting a behavioral health program located in a federally designated health professional shortage area from requiring a medical director to provide services onsite.
