Here are some of the hot issues as the 2004 Legislative Session develops:

SELLINGER AID

The Senate of Maryland passed the operating budget on Friday, March 19th. The Senate's version of the operating budget includes $37.3 million for the Sellinger Aid program, which is an increase of $5.9 million over the Governor's allowance. This is a $2.4 million increase for Johns Hopkins over our fiscal 2004 appropriation.

The Maryland House of Delegates will not pass their operating budget until Friday. However, the House Appropriations Committee voted to provide $32.5 million for the Sellinger program, a total increase of about $1 million over the fiscal 2004 appropriation.

The difference between the Senate and the House for the Sellinger Aid program means the final operating budget will be decided by a Conference Committee over the next three weeks.

Additionally, both the Senate and the House of Delegates rejected efforts to rebase the Sellinger Aid formula. This ensures that the Sellinger Aid program will return to its full statutory funding level next fiscal year.

LIBRARY SHELVING FACILITY

The Senate Capital Budget Subcommittee on Thursday approved a $2 million grant for Johns Hopkins to construct an off-site library shelving facility on the campus of the Applied Physics Lab, in Laurel. The decision now goes to the full Senate Budget and Taxation Committee and then to the full Senate for final approval. The House of Delegates will consider the Capital Budget next week.

HB1201  Compulsive Gambling - Prevalence Study and Replication Prevalence Studies
The bill would require DHMH to conduct a prevalence study and replication prevalence studies to measure the rate of problem and pathological gambling in Maryland. The initial study would be completed on or before September 30, 2005 and the replication studies would be conducted at least every 5 years.

HB 1410   Health Insurance - Treatment of Morbid Obesity
This bill states that payers will provide coverage for treatment of morbid obesity through gastric bypass or another surgical method if: the method is recognized by the NIH as effective for long-term reversal of morbid obesity, and the patient meets guidelines recognized by the NIH. Existing language that states that coverage be provided if surgery is "consistent with criteria approved by the NIH" is being stricken.

Tort Reform

SB 840    Maryland Physicians Noneconomic Damages Reimbursement Fund
This bill establishes the Maryland Physicians Noneconomic Damages Reimbursement Fund. The purpose of the fund is to subsidize the final awards for noneconomic damages over $500,000 for physicians practicing medicine in the state. Each physician who practices medicine in the state shall pay into the fund, for the first year $750 and for each subsequent year $500 annually. Hospitals shall pay an annual fee of $10,000. A medical malpractice insurer may apply to the fund for reimbursement for the amount of a noneconomic damages award that is in excess of $500,000.

Effective Date: January 1, 2005
